Scope of personal data

In pursuing the above objectives, the Administrator will process the following types of data:

  1. If you send us a message via email or through a form, or provide information by phone, we will process the data contained in that message. Providing us with data in this way is voluntary. You can request the deletion of this data at any time.
  2. If you subscribe to a newsletter, we will process your name, email address and basic statistical data (such as the times and number of message opens). Subscribing to the newsletter is voluntary, and you can opt-out at any time.
  3. If you sign up for a webinar, we will process your name, email address, and, if provided, data regarding your position, company name, company size and industry. Signing up for a webinar is voluntary, and you can opt-out at any time.
  4. If you download a webinar recording through a form on our website, we will process your name and email address. Downloading free materials is voluntary. After downloading, you can remove your email address from our database.
  5. Other data that the Administrator processes includes IP address and other data stored in cookies. You decide to what extent we can use cookies with your data.   7. Personal data is transferred to entities based outside the European Economic Area on the basis of a European Commission adequacy decision (Data Privacy Framework) or standard contractual clauses approved by the European Commission, together with additional safeguards provided for in the agreements concluded with those entities.

The recipients of your personal data are:  

  1. If you have subscribed to our newsletter, your data will be transferred to MailerLite Limited, based in Ireland, 88 Harcourt Street, Dublin 2, D02 DK18, which handles the sending and analytics of the newsletter on the basis of a data processing agreement concluded with us.
  2. If you have consented to marketing cookies, your data stored in cookies will be transferred to our advertising partners (Facebook, LinkedIn).
  3. If you have consented to analytical cookies, your data stored in cookies will be processed by software providers analyzing traffic on our site (e.g., Google Analytics, Microsoft Clarity).
  4. If you fill in a form on our website, your data will be transferred to Make (make.com), which, on the basis of a data processing agreement concluded with us, automatically transfers it from MailerLite to our CRM system (HubSpot). The data is stored on servers in the European Union.
  5. If you contact us by email, your data will be processed within the Microsoft 365 email service provided by Microsoft Ireland Operations Limited, based in Ireland, on the basis of a data processing agreement concluded with us. The data is stored on servers in the European Union and, to a limited extent, may be transferred to Microsoft Corporation, based in the USA, on the basis of the Data Privacy Framework or standard contractual clauses.

Your data is not transferred to countries outside of the EEA or to international organizations, except for the partners listed below:

Vizyble stores users' personal data for the period necessary for the processing purposes for which they were collected and in accordance with applicable regulations. The criteria for determining this period for each category of data are described below.

  5. promotion of its services by the Administrator (email newsletter), only in the case of your consent to process data for this purpose.

2. The Administrator processes your data based on:

  1. consent given by you (Article 6 (1) (a) of the GDPR), consent is voluntary and can be withdrawn at any time.
  2. contracts concluded or actions taken to conclude them (Article 6 (1) (b) of the GDPR);
  3. legal obligations incumbent upon the administrator as a party to the contracts (Article 6 (1) (c) of the GDPR).
  4. the legitimate interests of the Administrator (Article 6(1)(f) of the GDPR). The Administrator considers the following to be legitimate interests:
    1. securing its claims against contractors;
    2. protection against claims from contractors;

3. The recipients of your data may be: an accounting office, service providers (collaborators on a B2B basis), and state institutions, considered as data recipients.

If you have purchased subscriptions for Tableau Software, Alteryx, Fivetran, Snowflake, the Administrator informs that in order to perform the sales contract, your data in the form of: first name, last name, email address, phone number will be transferred to the manufacturer of this software, whose headquarters are located in the United States of America (USA). The transfer is based on Article 49(1)(b) of the GDPR as necessary for the performance of a contract between the data subject and the administrator.   1. in terms of data collected for contract performance, your personal data will be processed for the duration of the contract, and after its completion for 6 years in relation to accounting documents, and in the event of a legal dispute until the Administrator's claims become time barred. Documents related to the provision of services may be stored by the Administrator for a period longer than in the previous sentence due to warranty services or the protection of copyright related to the subject of the Administrator's activity.
  2. in terms of data processed for marketing purposes, your personal data will be processed until you object to the processing.
  3. in terms of data processed based on consent given, your data will be processed until you withdraw your consent.

You have the following rights: the right to access the content of your data and the right to rectify, delete, restrict processing, the right to data portability, the right to object, the right to withdraw consent to their processing at any time and in any form, unless the processing of your data is carried out in order to perform a contract by the Administrator or in order for the Administrator to comply with legal obligations towards state institutions.

7. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, Stawki 2 street, 00-193 Warsaw).

8. Providing your data is a necessary condition for the Administrator to take actions preceding the conclusion of a contract or in connection with the conclusion of a contract.

9. In case you give your consent for the processing of data for the purposes of promoting the Administrator's services in the form of an email newsletter, the consent provided by you is voluntary and can be withdrawn by you at any time.

Information on Data Processing for Contractors

1. Your personal data is processed for the purposes of:

  1. entering, performing contracts, and providing services to the Administrator by contractors, service recipients.
  2. fulfilling the legal obligations of the Administrator towards state institutions in connection with the implementation of contracts and services.
  3. debt collection, in the event of non-fulfillment of obligations by the contractor towards the Administrator.
  4. security and protection against claims (e.g., copyright).

2. The Administrator processes your data based on:

  1. contracts concluded or actions taken to conclude them (Article 6 (1) (b) of the GDPR);
  2. legal obligations incumbent upon the administrator as a party to the contracts (Article 6 (1) (c) of the GDPR).
  3. realization of the legally justified interests of the Administrator (Article 6(1)(f) of the GDPR). The Administrator considers securing its claims against contractors and protection from contractors' claims as legally justified interests.

3. The recipients of your data may be entities cooperating with the Administrator in terms of, among others, accounting services and collaborators of the Administrator (providing services on a B2B basis).

4. Your personal data will be stored for the period: of the legal relationship, and after its termination for 6 years in relation to accounting documents, and in the event of a legal dispute until the Administrator's claims become time barred. Documents related to the provision of services may be stored by the Administrator for a period longer than the previous sentence due to warranty services or copyright protection related to the subject of the Administrator's activity.

You have the following rights: the right to access the content of your data and the right to rectify, delete, restrict processing, the right to data portability, the right to object, the right to withdraw consent to their processing at any time and in any form, unless the processing of your data is carried out in order to perform a contract by the Administrator or in order for the Administrator to comply with legal obligations towards state institutions.

7. Providing your data is a necessary condition for the Administrator to take actions preceding the conclusion of a contract or in connection with the conclusion of a contract.

Information on Data Processing for Job Candidates

1. Your personal data will be processed for recruitment purposes based on Article 6(1)(a) and (c) of the GDPR.

2. The recipients of your data may be entities that regularly cooperate with the Administrator in terms of, among others, accounting services (accounting office) and state institutions to which the Administrator is obligated to transfer your data under separate regulations, e.g., Social Insurance Institution, Tax Office, National Labour Inspectorate.

3. Your personal data will be stored until the end of the recruitment process.

4. You have the right to access the content of your data and the right to rectify, delete, restrict processing, the right to data portability, the right to object, the right to withdraw consent to their processing at any time and in any form, unless the processing of your data is related to the performance of a contract (e.g., employment contract, civil law contract, etc.) or is conducted due to the necessity for the administrator to comply with legal obligations towards state institutions.

5. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, Stawki 2 street, 00-193 Warsaw).

6. Providing your personal data to the extent resulting from Article 221 of the Labour Code is necessary to participate in the recruitment process. Providing other data is voluntary.

Information for individuals providing services under civil law contracts and for employees employed under employment contracts

1. If you are an employee and have concluded an employment contract with the Administrator, your data is processed for the purposes of:

a) your employment, on the basis of the employment contract concluded with you (Article 6(1)(b) of the GDPR);

b) fulfilling the legal obligations incumbent on the Administrator as your employer (Article 6(1)(c) of the GDPR);

c) the legitimate interests of the Administrator (Article 6(1)(f) of the GDPR). The Administrator considers securing its claims and protection against claims to be its legitimate interest.

2. If you are a contractor and have concluded a civil law contract (umowa zlecenia) with the Administrator, your data is processed for the purposes of:

a) taking steps to conclude and perform the contract (Article 6(1)(b) of the GDPR);

b) fulfilling the legal obligations incumbent on the Administrator as the principal (Article 6(1)(c) of the GDPR);

c) the legitimate interests of the Administrator (Article 6(1)(f) of the GDPR). The Administrator considers securing its claims and protection against claims to be its legitimate interest.

3. The recipients of your data may be entities cooperating with the Administrator in terms of, among others, accounting services (accounting office) and state institutions to which the Administrator is obliged to transfer your data under separate regulations, e.g. the Social Insurance Institution (ZUS), the Tax Office and the National Labour Inspectorate.

4. It is not possible to specify a single deletion date for your data due to the number of legal provisions in this area. However, the employer indicates that your data will be kept for the following periods:

a) 3 years for data related to pursuing employment claims, from the date the claim became due;

b) 10 years for data concerning claims established by a final decision of a dispute resolution body, as well as claims established by a settlement concluded before such a body in the manner provided for in the Labour Code, from the date the decision became final or the settlement was concluded;

c) 10 years for data related to keeping reports on the circumstances and causes of an accident at work, together with other post-accident documentation;

d) 10 years for statutory data constituting the employee's personnel records (employed before 1 January 2019 where the employer exercised the right to shorten the retention period, or employed after 1 January 2019), counted from the end of the employment relationship with the employer;

e) 50 years for statutory data constituting the employee's personnel records (employed before 1 January 1999, or before 1 January 2019 where the employer did not exercise the right to shorten the retention period), counted from the end of the employment relationship with the employer;

f) 12 months after the deadline for the employee to collect the personnel records – for data constituting personnel records.

5. You have the following rights:

a) the right to access your data and the right to rectify, erase and restrict its processing;

b) the right to data portability;

c) the right to object;

d) the right to withdraw consent to processing at any time and in any form, unless the processing is related to your legal relationship with the Administrator (e.g. employment contract, civil law contract) or is necessary for the Administrator to comply with legal obligations towards state institutions;

e) the right to lodge a complaint with the President of the Personal Data Protection Office (Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw).

6. Providing your personal data is a condition for concluding an employment contract or a contract for the provision of services, in particular with regard to the data specified in the Labour Code or social security legislation. Providing other data is voluntary.
